A person who, in good faith, seeks medical assistance for someone experiencing (or believed to be experiencing) an alcohol- or drug-related overdose may not be arrested, charged, prosecuted, or penalized for certain drug-possession offenses if the evidence was obtained as a result of seeking that medical help. The same protection extends to the person experiencing the overdose.
Under Florida's naloxone access law, pharmacists may dispense naloxone under a standing order without a personal prescription, and over-the-counter naloxone is widely sold. Any person may possess and administer naloxone to someone believed to be overdosing.
