Georgia's overdose Good Samaritan statute is codified at OCGA § 16-13-5, enacted in 2014 as the 911 Medical Amnesty and Expanded Naloxone Access Law. It grants limited immunity from arrest, charge, and prosecution to a person who in good faith seeks medical help for someone overdosing — and to the overdose victim — when the evidence was obtained because they sought that help.
The protection covers possession of less than four grams of a controlled substance, less than one ounce of marijuana, and drug-related objects (paraphernalia). Under the same law, naloxone is available at Georgia pharmacies without a personal prescription, and any person may possess and administer it to someone believed to be overdosing, with civil and criminal immunity for doing so.

- Trafficking or possession with intent to distribute
- Possession of four grams or more of a controlled substance
- Outstanding warrants
- Probation or parole violations
- Offenses unrelated to the overdose (DUI, firearms, assault, etc.)

Will I get arrested if I call 911 for someone overdosing in Atlanta?
No — not for the drugs that caused the overdose, within limits. Georgia's 911 Medical Amnesty Law, OCGA § 16-13-5, gives both the caller and the overdose victim immunity from arrest, charge, and prosecution for possession of less than four grams of a controlled substance, less than one ounce of marijuana, and paraphernalia, when the evidence was found because someone sought medical help. It does not protect against trafficking, four grams or more, outstanding warrants, or unrelated offenses. The safest thing is always to call 911, stay with the person, and give naloxone if you have it.
Does Georgia Medicaid cover rehab in Atlanta?
For those who qualify, yes — but Georgia has not expanded Medicaid under the ACA, so eligibility is narrower than in most states. Georgia Medicaid is delivered through the Georgia Families program and three care management organizations — Amerigroup, CareSource, and Peach State Health Plan — which cover outpatient treatment, intensive outpatient, and medication for opioid use disorder. A limited program, Georgia Pathways to Coverage, extends Medicaid to some working adults. If you are uninsured and do not qualify, call the Georgia Crisis & Access Line at 1-800-715-4225 to reach state-funded treatment, or use a federally qualified health center on a sliding scale.
Where can I get free naloxone in Atlanta?
Several ways. The Atlanta Harm Reduction Coalition distributes free naloxone and fentanyl test strips, and free test strips are also available through Fulton County and StopHIVATL partnerships. Under Georgia's standing order, any Atlanta pharmacist can dispense naloxone without a personal prescription, and over-the-counter naloxone is sold at major pharmacies. How much does rehab in Atlanta cost without insurance?
It depends on the setting, and Atlanta's non-expansion context means more residents rely on safety-net options. GCAL (1-800-715-4225) connects uninsured residents to state-funded treatment; Grady Health System is a safety-net hospital that treats patients regardless of ability to pay; and federally qualified health centers offer sliding-scale care and buprenorphine. Self-pay rates at private residential programs in metro Atlanta typically run $15,000–$35,000 for a 30-day inpatient stay — ask each program directly about sliding-scale, scholarship, or opioid-settlement-funded beds.
Can I get medication for opioid use disorder (buprenorphine or methadone) in Atlanta?
Yes. Buprenorphine (Suboxone) is prescribed in many Atlanta outpatient clinics, FQHCs, and some emergency departments. Methadone is dispensed only at federally certified opioid treatment programs (OTPs), as required by federal law (42 CFR Part 8), several of which operate in metro Atlanta. Georgia Medicaid's three CMOs and most commercial plans cover medication for opioid use disorder.
