The overdose picture in San Diego County
Fentanyl drove San Diego County overdose deaths to roughly 800 a year — but 2023 brought the first decline, alongside one of the country's more supportive harm-reduction policy environments.
San Diego County averaged about 800 fentanyl-related deaths a year in 2021 and 2022, and in 2023 recorded the first decrease since the county began tracking fentanyl deaths, according to the County of San Diego HHSA. As a major border and port region, San Diego sits at the front line of the illicit-fentanyl supply.
As elsewhere, illicitly manufactured fentanyl drives the deaths — increasingly in counterfeit pills and mixed into the cocaine and methamphetamine supply, so people who do not knowingly use opioids still face overdose risk. Unlike states such as Texas, California has made the basic prevention tools legal and available: naloxone and fentanyl test strips are distributed widely.
In fall 2023 the county launched its Overdose Surveillance and Response (OSAR) program — a collaboration of Public Health, Behavioral Health, the Medical Examiner, and EMS that does street-level outreach to distribute naloxone and fentanyl test strips and link people to care. This data-driven, harm-reduction-forward response is part of why deaths began falling.

California's overdose Good Samaritan statute is codified at Cal. Health & Safety Code § 11376.5. It provides that it is not a crime to be under the influence of, or to possess for personal use, a controlled substance or paraphernalia when a person in good faith seeks medical assistance for someone experiencing a drug-related overdose and does not obstruct medical or law-enforcement personnel. The same protection covers the person who overdoses and needs help.
Under California law, naloxone is available without a personal prescription through a statewide standing order and over the counter, and the California Naloxone Distribution Project supplies free naloxone to community organizations. Fentanyl test strips are legal in California and distributed by county and community harm-reduction programs.
What the immunity does NOT cover
- Selling, providing, giving, or exchanging controlled substances
- Forcing or coercing another person to take drugs
- Outstanding warrants or unrelated offenses
- Obstructing medical or law-enforcement personnel at the scene

CURES (California prescription monitoring)
California's prescription drug monitoring program is CURES (Controlled Substance Utilization Review and Evaluation System), administered by the California Department of Justice. No — California's protection is relatively broad.
